ELIGIBILITY:
The Ynot Italian Summer Family Fun Giveaway is open to the public.

To enter 1 of 28 Ynot Italian Cooler Swag Bags + 4 Tides tickets and a gift from Family Fun Xperience, entrants can register to win on site at any Ynot Italian location or submit online for a chance at the Grand Prize package. To enter to win the Grand Prize package, entrants must be Ynot Italian Loyalty/Family Rewards members and can register to win on site at any Ynot Italian location or submit online.

ENTRY PERIOD:
The Ynot Italian Summer Family Fun Story Contest entry period begins at 8AM on Thursday, July 1st 2021 ending at 11:59AM on Wednesday, July 21st 2021 (“Entry Period”) on site and 11:59PM on Friday, July 23^rd online. Entries submitted before or after the Entry Period will be ineligible.

HOW TO ENTER:
All participants must fill out a Ynot Italian Summer Family Fun Contest Entry Form and enter the required fields including name, email, division entered and submission information. The terms of the Release must be read and accepted in order to participate in the Contest. Link to form can be found on Ynot Italian’s Summer Family Fun blog page.

WHAT TO ENTER:
The above All submissions must adhere to the following rules to be considered: • Only one entry per person. • Entries must be provided in English. • The story must be original work submitted by the entrant and not previously published. • Theme of story should relate to one or more of the following: stories of tradition at Ynot Italian as a Ynot Italian family: highlights of celebration of family, fun • even exciting adventures your family has taken or plan to take • Story must not violate another person’s rights, including but not limited to copyright. • Story must not contain sexually explicit, obscene, violent or other objectionable or inappropriate content.

JUDGING:
Story submissions in the following categories: stories will be judged on the following criteria: technical quality, relevance to contest theme, readability, creativity/originality and overall impact. Winners will be notified via the contact information provided at time of entry.

POTENTIAL WINNER REQUIREMENTS:
All entries must be accompanied by completed forms, which include the Liability Release Form. Entries submitted by individuals under the age of 18, must have a parent or legal guardian complete and accept the terms of Liability Release Form. Winners consent to their story being used/displayed along with their name.

OWNERSHIP INTERESTS:
If you submit a story to enter in the Contest, you grant Ynot Italian, a royalty-free, nonexclusive right, in perpetuity, to: • Display the story on the Internet, on Ynot Italian’s website (www.ynotitalian.com), and on Ynot Italian’s Facebook page in support of the contest; and • Allow story to be printed in local publications as a Family Fun contest category winner, if selected, along with your name and photo location; and • Use the story on future promotions for Ynot Italian including, but not limited to, posters, registration booklets, advertisements (print and digital) and electronic newsletters; and • Allow story to be printed on signage to be displayed in Ynot Italian locations and/or Facilities; and • Use, in connection with the Ynot Share Your Family Fun Story Contest, your name, city and state of residence in promotions and publications. Only first name and last initial can be used if provided written request; and • Allow Ynot Italian partner organizations to use the story for future promotions; and • Allow third parties to share the story on the following social media platforms: Twitter, Instagram, and Facebook.

GENERAL CONDITIONS:
In the event that the operation, security, or administration of the Ynot Italian Summer Family Fun Story Contest is impaired in any way, Ynot Italian may, in its sole discretion, either: (a) suspend the contest to address the impairment and then resume the contest; or (b) award the prize(s) from among the eligible entries received up to the time of the impairment. Ynot Italian reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Ynot Italian’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Ynot Italian by mail shall not be deemed proof of receipt of that communication by Ynot Italian. In the event of a dispute as to the owner of an online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the owner. This Ynot Italian Contest is subject to federal, state, and local laws and regulations and is void where prohibited.

RELEASE AND LIMITATIONS OF LIABILITY:
By entering, you agree to release and hold harmless the Ynot Italian entity and its agents, volunteers, servants, employees and officials (the “Released Parties”) from and against any and all claims or causes of action arising out of participation in the contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors; (c) late or undelivered email; (d) errors in the administration of the Contest; or (e) injury or damage to persons or property. You waive the right to claim any attorney fees and any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages.

PRIVACY AND PUBLICITY:
Any information you submit as part of the Ynot Italian Contest will be used in accordance with Ynot Italian’s Privacy Policy, if applicable. Except where prohibited, you consent to Ynot Italian’s use of your name in any list of winners (if applicable) and for promotional purposes in any media with further payment or consideration.

DISPUTES:
You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Ynot Italian Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court of competent jurisdiction in the City of Virginia Beach or the U.S. District Court for the Eastern District of Virginia, Norfolk Division. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Ynot Italian in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Virginia, without giving effect to any choice of law or conflict of law rules (whether of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Virginia.

RESULTS:
Results will be posted on the Ynot Italian website, ynotitalian.com, by Wednesday July 28th, 2021.

SOCIAL MEDIA RELEASE:
In consideration for having my name, photograph(s), video(s), voice(s), sound(s) and any other form of visual or sound reproduction(s), or likeness(es) (“Images and Sounds”) and personally identifiable information (“PII”) collected and considered for inclusion in the Ynot/Old Dominion University® Football Fans of the Game (“Contest”), the sufficiency of which is acknowledged and agreed, I agree as follows:

I grant to Ynot® permission to take and use the Images and Sounds and to take and use my PII pursuant to the Ynot Social Media Policy http://www.ynotitalian.com/social-media-disclaimer. I agree Ynot has no obligation to use the Images and Sounds and PII in any manner.
I hereby grant to Ynot a non-exclusive, irrevocable, sub licensable license to use all Images and Sounds in any medium throughout the world in perpetuity in connection with the sweepstakes. I also grant Ynot the right to use, re-use, publish, re-publish, retouch, reproduce, manipulate and change the Images and Sounds and to use the Images and Sounds with or without my and/or my sweepstakes name(s), or as a testimonial, as needed.
I agree that Ynot does not have to submit the Images and Sounds to me for inspection or approval and that Ynot is not liable to the undersigned for anything in connection with its use of the Images and Sounds, including distortions, alterations, and special effects.
I represent and warrant that the rights I am granting Ynot do not conflict with any other agreements, restrictions or commitments I have; that I have read and understood the terms of this Release and I am eighteen (18)* years of age or older and I have the right to enter into contracts in my own name.
I agree that the consideration I have received is in full payment for the rights I have granted to Ynot and that Ynot has no obligation to pay me anything else for its use of the Images and Sounds.
This agreement shall be binding upon my survivors, heirs, descendants, administrators, executors and all others who have or may have a legal claim or rights by virtue of my agreeing to this Release.

The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook®, Twitter® or Instagram®. You are providing your information to Ynot and not to the above mentioned. The information you provide will only be used for Contest and authorized promotional purposes, as outlined in the official rules. By entering this Contest you are agreeing to this consent release.
